Antidoturi juridice europene pentru manipularea online

Manipulation is a form of influence with a negative connotation. It can take various forms in virtual space and has harmful effects, among others, on the autonomy of will and freedom of thought. In the work we propose, we will first explain what manipulation and online manipulation are and what the online manipulation types are. We will then try to identify the antidotes to online manipulation, using the European instruments in force, with a particular emphasis on virtual assistants. We will therefore appeal to the New Product Liability Directive, the Unfair Commercial Practices Directive, the General Data Protection Regulation (GDPR), and, for the violation of freedom of thought, the European Convention on Human Rights.

Manipularea este o formă de influenţă cu o conotaţie negativă. Poate lua diverse forme în spaţiul virtual și are efecte nocive, printre altele, asupra autonomiei de voinţă și a libertăţii de gândire. În lucrarea pe care o propunem, vom explica, mai întâi, ce este manipularea, manipularea online și care sunt tipurile acesteia din urmă. Vom încerca, apoi, să depistăm antidoturile manipulării online, utilizând instrumentele europene în vigoare, insistând asupra cazului particular al asistenţilor virtuali. Vom face apel, astfel, la noua directivă a răspunderii pentru produse, la directiva cu privire la practicile comerciale neloiale, la Regulamentul general pentru protecţia datelor (GDPR), iar pentru încălcarea libertăţii de gândire, la Convenţia europeană a drepturilor omului.
