Dinamica dreptului transnaţional

The dynamics of transnational law constitues a generous research topic. However, the aim of this article is more modest, limiting itself at preliminarly contemplating the way transnational law is evolving effortlessly. Conceptualized also as a methodological tool, transnational law inspires the so-called „network” contracts and the so-called „organisational contract” of the social life, business life included.
The dynamics of international law and of the concept of confl ict of laws exhausted its resources in the light of the legal demarches aimed at assessing the „network” contracts and the organisational contract of the business life especially. It seems that the transnational law offers a suitable methodological tool in order to nourish the conceptual need, if any, to understand our Time.

Dinamica dreptului transnaţional constituie un generos subiect de cercetare. Scopul acestui articol este însă mai modest. Concret: mi-am propus să contemplu preliminar modul de evoluţie naturală a dreptului transnaţional însuși. Conceptualizat și ca instrument metodologic, dreptul transnaţional inspiră așa-numitele „reţele” de contracte, precum și așa-numitul „contract cu vocaţie de organizare” a vieţii sociale, inclusiv a vieţii de afaceri. Dinamica dreptului internaţional și a instituţiei conflictului de legi și-a epuizat resursele în demersul juridic de evaluare a „reţelelor” de contracte și a contractului cu vocaţie de organizare a vieţii de afaceri în special. Se pare că dreptul transnaţional oferă un instrument metodologic potrivit pentru a hrăni nevoia conceptuală, dacă există, de a înţelege Timpul nostru.
