Tratamentul creditelor în monedă străină în Spania

The case-law of courts from EU states in the field of foreign currency loans reveal not only the common legal background but also the common problems that both the courts and the beneficiaries of the credits from EU Member States have to address. Given the current context of creating a uniform legislation for protecting credit consumers around Europe, an appeal to the case-law from other Member States can prove to be a source of inspiration for the Romanian legislator and for the legal practitioners. Having that in mind, we thought it would be useful to have an analysis of the trends in the case-law of Spanish courts towards foreign currency credits, particularly focusing on a complex product used by creditors in this country – “hypoteca multidivisa” (multicurrency mortgage).

Jurisprudența instanțelor din statele membre ale UE în domeniul creditelor în monedă străină reflectă rădăcinile normative comune, precum și problemele similare cu care se confruntă instanțele și împrumutații din spațiul UE. În contextul actual de uniformizare europeană a legislației în domeniul protecției consumatorilor de credite, apelul la jurisprudența instanțelor străine poate servi drept sursă de inspirație atât pentru legiuitorul român cât și pentru practicienii dreptului. Acesta este motivul pentru care am considerat necesară o analiză a tendințelor jurisprudențiale în Spania cu privire la creditele în moneda străină, în concret, raportat la un produs complex utilizat în această țară denumit “hypoteca multidivisa” (credit ipotecar cu clauză multivalutară).
