Scurte considerații privind aplicarea normelor de drept procesual civil în timp

The New Civil Procedure Code and the law for its application generate a transformation of the paradigm as regards the temporal application of the civil procedural law, operating a replacement of the system based on the isolation of the procedural act by the system focused on the stages of the civil process.
The law for the application of the new Civil procedure code was requisite in order to endorse the transition form the former code to the new code, the conflicting norms being applicable only to the normative acts which are subsequent to its entry into force.
The new Code distinguishes, in this respect, by an excess of regulation, wastefully attempting to cover the hypothesis established by the old Code.

Noul Cod de procedură civilă, ca şi legea de punere în aplicare a acestuia operează o schimbare de paradigmă în ceea ce priveşte aplicarea normei de drept procesual civil în timp, trecându-se de la sistemul bazat pe principiul izolării actului de procedură la cel ce are în vedere fazele procesului civil.
Legea de punere în aplicare era necesară pentru a face trecerea de la vechiul cod la cel nou, normele conflictuale din noul cod urmând să se aplice doar actelor normative ulterioare intrării sale în vigoare.
Noul cod se caracterizează, sub acest aspect, prin supralegiferare, în încercarea inutilă de a acoperi ipoteze reglementate de cel vechi.
