Protecţia consumatorului de cetăţenie în războiul comercial de apărare

When instituting retaliatory tariffs on imports from a State who initiated such alleged protectionist measures, aiming to convince that State to renounce the tariffs initially imposed, it is possible to disproportionately affect some of its own citizens or of the companies established under the national law. In such cases, the State can award them certain compensatory benefits. Considering the premise that citizenship is not a determinism, but the consequence of a free choice, as is nationality for companies, this article tends to reveal the conditions under which such benefits are owed by the State on the grounds of the right to an adequate standard of living or, respectively, of economic freedom, and not just as affirmative action.

În cazul instituirii unor tarife vamale de retorsiune la importurile dintr-un stat care a iniţiat astfel de măsuri presupus protecţioniste, în scopul de a convinge acel stat să renunţe la tarifele vamale iniţial impuse, este posibilă afectarea disproporţionată a unora dintre cetăţenii proprii sau dintre companiile constituite conform dreptului naţional. În astfel de situaţii, statul poate acorda acestora anumite beneficii cu rol compensatoriu. Pornind de la premisa că cetăţenia nu este un determinism, ci consecinţa unei alegeri libere, cum este și naţionalitatea în cazul companiilor, acest articol tinde să releve condiţiile în care astfel de beneficii sunt datorate de stat în temeiul dreptului la un nivel de trai decent sau, după caz, al libertăţii economice, iar nu doar ca măsuri afirmative.
