Finanţarea structurilor sportive în România

A significant and intricate component of Romanian sports law involves financing the activity of sports structures. In Romania, an overwhelming majority of sports structures are funded from public sources. Whether we refer to public or private law sports structures, both have the capacity to benefit from public funds allocated by Romanian state through projects for non-profit activities of general interest, financing contracts, or subsidies, due to the subordination of the sports structure to a public law entity, such as a local or county council or a ministry. The present article aims to provide an introduction to the financing sports activity within Romanian sports law, the methods of financing sports structures, and to address some of the challenges arising from the diversity and overlapping regulations within this legal framework.

O componentă importantă și în același timp complexă a dreptului sportului intern o reprezintă finanţarea activităţii structurilor sportive. În România, o majoritate covârșitoare a structurilor sportive sunt finanţate din fonduri publice. Fie că ne referim la structurile sportive persoane juridice de drept public sau privat, ambele au aptitudinea de a beneficia de fonduri din partea statului român alocate prin proiecte pentru activităţi nonprofit de interes general, contracte de finanţare sau subvenţionate ca urmare a subordonării structurii sportive unei entităţi de drept public, spre exemplu unui consiliu local, judeţean sau unei autorităţi publice centrale. Acest articol își propune să reprezinte o introducere în finanţarea activităţii din dreptul sportului din România, a modului de finanţare al structurilor sportive și să trateze o parte din problemele cu care se confruntă, din cauza diversităţii și a multiplelor reglementări suprapuse, acest sistem juridic.
