Noutăţi privind răspunderea antreprenorului potrivit Codului civil (I)

This article represents the first part of a study aimed to provide an overview of the main novelties related to contractor’s liability under the Romanian Civil code. In their study, the authors referred to the relevant provisions of the Québec Civil code, as it represented one of the main sources of inspiration for the Romanian Civil code, and to the related doctrine as well. The authors also outlined the potential issues to arise due to the different means of interpretation of the provisions of the Romanian Civil code or out of the correlation of the said provisions with the legal norms from the special legislation. This first article shall cover the general provisions from the Romanian Civil code, relevant for the contractor’s liability and applicable to all contractor agreements.

Acest articol reprezintă prima parte a unui studiu care îşi propune să ofere o privire de ansamblu asupra principalelor noutăţi privind răspunderea antreprenorului potrivit Codului civil român. În studiul lor, autorii au făcut referiri la prevederile relevante din Codul civil din provincia Québec, întrucât acesta a reprezentat una dintre principalele surse de inspiraţie în redactarea Codului civil român, precum şi la doctrina aferentă acestuia. De asemenea, autorii au evidenţiat potenţialele probleme ce pot apărea din cauza diverselor modalităţi de interpretare a prevederilor Codului civil, sau din corelarea acestor prevederi cu cele din legislaţia specială. Acest prim articol va acoperi prevederile generale din Codul civil român, relevante pentru răspunderea antreprenorului şi aplicabile tuturor contractelor de antrepriză.
