Privire generală asupra măsurilor tehnice și organizatorice necesare pentru implementarea efectivă a Regulamentului general privind protecţia datelor

The effective protection of personal data throughout the European Union required the strengthening and setting out in detail the obligations of those who process and determine the processing of personal data. In order to ensure a processing which meets the requirements of the General Data Protection Regulation and protects the rights of data subjects, the controller and the processor have the obligation to apply appropriate technical and organisational measures designed to implement in an effective manner the data-protection principles and to integrate the necessary safeguards, so as to protect the rights and freedoms of natural persons. Therefore this article aims to analyse this practical aspect of the effective implementation of Regulation (EU) 2016/679 taking into account both the legislative framework and the position of the European Data Protection Board (EDPB).

Protecţia efectivă a datelor cu caracter personal în întreaga Uniune Europeană a necesitat consolidarea și stabilirea în detaliu a obligaţiilor celor care prelucrează și decid prelucrarea datelor cu caracter personal. Pentru a asigura o prelucrare ce îndeplinește cerinţele Regulamentului general privind protecţia datelor și protejează drepturile persoanelor vizate, operatorul și persoana împuternicită de acesta au obligaţia de a implementa măsuri tehnice și organizatorice adecvate destinate să pună în aplicare în mod efi cient principiile de protecţie a datelor și să integreze garanţiile necesare, astfel încât să fie protejate drepturile și libertăţile persoanelor fi zice. Astfel, acest studiu își propune să analizeze acest aspect practic privind efectiva implementare a Regulamentului (UE) 2016/679 având în vedere atât cadrul legislativ, cât și poziţia Comitetului european pentru protecţia datelor (CEPD).
