Evoluţia jurisprudenţei Curţii de Justiţie a Uniunii Europene referitoare la jocuri de noroc şi pariuri sportive: o perspectivă asupra pieţii interne

This paper will discuss the evolution of the ECJ’s case law on the field of sports betting and gambling. Member States remain competent to regulate gambling and sports betting and to structure their national policies on these areas. The gambling and sports betting market is part of the internal market and as a matter of fact is subjected to the rules guaranteeing the smooth operation of the internal market. The case law of the ECJ will be discussed extensively. Emphasis will be given on the latest case decided by the ECJ, Placanica. This latter case has significant implications on possible justifications which could be invoked by the Member States and on the application of the principle of proportionality. Apart from negative integration, the possibility of positive integration will also be analyzed.

Acest articol va pune în discuţie evoluţia jurisprudenţei CJUE în domeniul pariurilor sportive şi a jocurilor de noroc. Statele membre rămân competente să reglementeze jocurile de noroc şi pariurile sportive şi să-şi configureze politicile naţionale în aceste domenii. Piaţa jocurilor de noroc şi a pariurilor sportive face parte din piaţa internă şi, în fapt, se supune reglementărilor care garantează fluenta funcţionare a pieţii interne. Jurisprudenţa CJUE va fi discutată pe larg. Va fi subliniat ultimul caz soluţionat de către CJUE, Placanica. Acest ultim caz, are implicaţii semnificative asupra posibilelor justificări ce ar putea fi invocate de Statele Membre şi asupra aplicării principiului proporţionalităţii. De asemenea în afara integrării negative, urmează să fie analizată posibilitatea integrării pozitive.
