Taxa de poluare auto justifică protecţia mediului eludarea normelor dreptului comunitar?

In this paper, I will discuss about the problem of car pollution tax, a tax liability which has raised many issues both technically and in the practice of national courts. In a systematic manner, I will turn on issues concerning the conflict of duty with the norms of the European Union, interventions of the European Court of Justice in similar cases, also analyzing the risk of completion of infringement procedure by the European Commission and the motive for establishing this tax, respectively the environmental protection using the funding programs of the Fund for Environment. Along the way, there will be found analyzed elements of comparative law, fragments of legal practice and the vision of „new rules” on interest of cent as well.

În această lucrare, voi discuta despre problema taxei de poluare auto, o obligație fiscală care a ridicat multe probleme atât din punct de vedere tehnic, cât și în practica instanțelor naționale. Într-un mod sistematic, mă voi ocupa de aspectele referitoare la conflictul cu normele europene, intervenții ale Curții Europene de Justiție în cauze similare, analizând și riscul de finalizare a procedurii de încălcare a dreptului comunitar de către Comisia Europeană și motivul pentru stabilirea acestei taxe, respectiv protecția mediului folosind programele de finanțare ale Fondul pentru Mediu. Pe parcurs se vor găsi elemente analizate de drept comparat, fragmente de practică juridică și viziunea „noilor reguli”.
